Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a) Construction site: Employees were exposed to the hazard of being struck by the boom on the Putzmeister concrete pumping truck on or about October 23, 2007. One feasible and acceptable abatement method to correct this hazard would be to ensure that equipment such as, but not limited to a Putzmeister concrete pumping truck is set up on stable soil that is competent to support the weight of the pump truck outriggers.
