Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious phyical harm to employees in that: (a) Construction site: Employees were exposed to the hazard of being struck by the boom on the Putzmeister concrete pumper truck on or about October 23, 2007. One feasible and acceptable abatement method to correct this hazard is to follow the manufacturer's operating manual section 2, page 48 which states "Always use timber blocks for placing booms with a net reach over 30 m. Never set the machine up on backfilled ground".ed
