Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee's were exposed to: (a) A fall hazard of approximately 7 feet while using a fold out step ladder in a way in which it was not designed to be used, such as folded and leaning it against the eve. One feasible and acceptable means of abatement would be to use the extension ladder that was designed for that type of work.
