Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Employees were exposed to the tipping/ shifting hazards associated with using a home made wood manbasket that was approximately 4 feet wider than the overall width of the LOADALL 508C All Terrain forklift plus 10 inches on both sides. (The width of the load bearing tires plus 10 inches on either side.) One feasible and acceptable method to abate this hazard is to provide a man basket that was designed to meet the width requirements of this type of forklift, an aerial lift or scaffolding.
