Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to: (a) Employees were exposed to a fall hazard of approximately 22 feet, while stocking and retrieving items from the upper storage shelves, using a Werner ladder, model (6008). One feasible and acceptable means to abate this hazard is to use a certified and rated ladder to retrieve items from the upper storage shelves, that is capable of accessing product safely.
