Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees in that employees were exposed to: (a) The hazards of struck by, crushing and falls resulting from overloading the basket of a GENIE Z 60/34 aerial lift because exact weight of object was not known and this aerial lift was not designed for lifting purposes. One feasible and acceptable method to correct this hazard would be to use a lifting device which was designed for that purpose such as a crane of extendable boom forklift.
