Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Freight Elevator: A struck or crushed by hazard due to not having a self-closing and self- locking gate or door at the freight elevator entrance in the basement. (b) Freight Elevator: A struck or crushed by hazard due to the lack of a sign stating 'DANGER, ELEVATOR HOISTWAY' at hoistway landings. One feasible and acceptable method to abate this hazard is to follow the recommendations for protecting employees from the hazards associated with an unprotected opening to a hoistway as specified in the American National Standards Institute (ANSI) A17.1-1971, Protection of Hoistways.
