Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck-by vehicular traffic: (a) Barker Tree Service, Inc.: An Employee working in the traffic zone was exposed to the hazard of being struck by oncoming traffic because of not wearing a retroreflective vest. Among other methods, recognized and feasible means of abatement to correct this hazard is to a) Ensure that employees working in traffic zones wear suitable retroreflective vest in accordance with appendix B of ANSI/ISEA 107-2004.
