Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to his employees in that employees were exposed to: (a) Repair Shop: On or about February 19, 2010 and at times prior thereto, employees were exposed to a struck by and crushing hazard while elevating vehicles using lifts such as, but not limited to two and four post (Bend-Pak and Master-Bend) lifts with missing floor anchor bolts and/or cracked concrete under or near various posts and anchor points. (b) Repair Shop: On or about February 19, 2010 and at times prior thereto, employees were exposed to a struck by and crushing hazard while elevating vehicles using lifts such as, but not limited to two and four post (Bend-Pak and Master-Bend) lifts with inoperative lift locks, positive stop locks, and swing arm locks. (c) Repair Shop: On or about February 19, 2010 and at times prior thereto, employees were exposed to a struck by and crushing hazard while elevating vehicles using various lifts throughout the shop(s) without the rated load capacity permanently marked on the lifts. (d) Repair Shop: On or about February 19, 2010 and at times prior thereto, employees were exposed to a struck by and crushing hazard while elevating vehicles using various lifts throughout the shop(s) without conducting annual inspections with a certified lift inspector. Abatement Note: Abatement certification and documentation is required for this item. Among other methods, one feasible and acceptable method to correct the hazards noted is to follow the requirements in ANSI/ALI ALOIM 2008 which include, among other requirements, the following: 1. Institute a preventive maintenance program according to the manufacturer's specifications. 2. Provide training to employees on proper use and care of the lifts. 3. Schedule and complete all periodic and annual inspections.
