5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were expose to: (a) Construction site: On or about February 22, 2010 and at times prior thereto, employee was exposed to hazards associated with tip over, such as but not limited to crushing, struck by and fall while working from an elevated platform approximately 28 feet in width. One feasible and acceptable abatement method to correct this hazard while using an all terrain forklift for lifting personnel is to follow the requirements set forth in ASME B56,6- 2002 Section 8.24.1. Abatement Note: Abatement certification and documentation is required for this item.
