Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which are free from
recognized hazards that are causing or likely to cause death or serious
physical harm to his
employees in that employees were exposed to:
(a) Auto repair shop: On or about February 22, 2010 and at times prior
thereto, employees
were exposed to struck by and crushing hazards while elevating vehicles
using Weaver lifts
which were not equipped with manufacturers locking devices.
(b) Auto repair shop: On or about February 22, 2010 and at times prior
thereto, employees
were exposed to struck by and crushing hazards while elevating vehicles on
an un-identified
lift with out a weight capacity and identification plate.
(c) Auto repair shop: On or about February 22, 2010 and at times prior
thereto, employees
exposed to struck by and crushing hazards while elevating vehicles which
had
not been
inspected for damage such as but not limited to metal fatigue, worn and
damaged parts.
(d) Auto repair shop: On or about February 22, 2010 and at times prior
thereto, employees
exposed to a crushing hazard while elevating vehicles with lifts having
deficiencies such as,
but not limited to, unknown hydraulic fluid levelsand lift surges both up
and down.
Abatement Note:
Among other methods, one feasible and acceptable method to correct the
hazards noted is to
follow the requirements in ANSI/ALI ALOIM 2008 which include, among other
requirements, the following:
1.    Institute a preventive maintenance program according to the
manufacturer's
specifications.
2.    Provide training to employees on proper use and care of the lifts.
3.    Schedule and complete all periodic and annual inspections.

this item.
