Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to his employees in that employees were exposed to: (a) Auto repair shop: On or about March 9, 2010 and at times prior thereto, employees were exposed to a struck by hazard while elevating vehicles using Air Over Hydraulic lifts without swing arm telescoping stops on the lifting arms. (b) Auto repair shop: On or about March 9, 2010 and at times prior thereto, employees were exposed to a struck by hazard while elevating vehicles using air over hydraulic single post lifts without having a rated load capacity posted. (c) Auto repair shop: On or about March 9, 2010 and at times prior thereto, employees exposed to a struck by hazard while elevating vehicles using various lifts with the lack of documented annual inspections performed by a certified lift inspector. Among other methods, one feasible and acceptable method to correct the hazards noted is to follow the requirements in ANSI/ALI ALOIM 2008 which include, among other requirements, the following: 1. Institute a preventive maintenance program according to the manufacturer's specifications. 2. Schedule and complete all periodic and annual inspections. 3. Post and maintain load rate chart with the load limit designated by the owners manual. Abatement Note: Abatement certification is required for this item.
