North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to confined space hazards:
a) on the construction site, the employer had not developed a written
confined space
entry program for employees required to enter confined spaces and included
the
following elements:
(i) test conditions in the permit space to determine if acceptable entry
conditions exist before entry is authorized to begin;
(ii) test and monitor the permit space as necessary to determine if
acceptable
entry conditions are being maintained during the course of entry
operations;
(iii)ventilate to obtain acceptable entry conditions;
(iv) communications equipment necessary for the attendant as necessary to
enable the attendant to monitor entrant status and to enable the attendant
to alert entrant of the need to evacuate the space;
(v) personal protective equipment insofar as feasible engineering and work
practice controls do not adequately protect employees;
(vi)lighting, barriers and equipment as needed for to work safely;
(vii) develop and implement procedures for summoning rescue and emergency
services, for rescuing entrant from permit spaces, for providing necessary
emergency services to rescued employees, and for preventing unauthorized
personnel from attempting a rescue.
Among other methods, one feasible and acceptable abatement method is to
develop a confined space entry program that includes the elements (i) -
(vii) listed
above or that follows the requirements listed in the American National
Standard
Safety Requirements for Confined Space, ANSI/ASSE Z117.1-2003.
