Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard as a result of tipover while operating a Powered Industrial Truck for failure to use the operator restraint devices or seat belts: a)loading/unloading dock- an employee was observed operating a Caterpiller DP30 forklift without the use of a seat belt. b)production area- an employee was observed operating a Mitsubishi forklift without the use of a seat belt. ABATEMENT NOTE: Among other methods, one feasible method to reduce this hazard is to follow the requirements of ANSI B56.1, Consensus Standard for Powered Industrial Trucks,in addition to requiring employees to use the restraint devices or seat belts.
