North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by the forklift in the event of an upset or tip-over: a)job site- forklift operators were not required to wear the forklift manufacturer equipped seatbelts while operating the different industrial trucks around the job site ABATEMENT NOTE: Among other methods, feasible and acceptable abatement methods to correct the hazard include: 1) Develop and implement operator rules and policies regulating seatbelt usage. 2) Enforce rules. 3) Conduct frequent and regular inspections to ensure compliance of rules. 4) Retrain operators found to be out of compliance of rules and policies.e
