General-duty citation text
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by the powered industrial truck in the event of a tip over or an accident: a)establishment - employees operate a Clark forklift to move parts and to load and unload trucks at loading dock. The forklift was not equipped with a seatbelt which could result in employee being thrown from lift truck in case of vehicular accident. Among other methods, feasible and acceptable abatement methods to correct this hazard is to install retrofit seatbelt available from manufacturer.
