North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a fall from elevation hazard created by improper ladder usage: a)blending area; for the employee who used a Werner 8-foot fiberglass stepladder on or about March 4, 2008 to clean the blender feed auger; the employee used the top step of the stepladder to access and clean the more highly elevated portions of the blender feed auger. Among other methods, one feasible and acceptable means of abatement would be to provide a mobile ladder stand, which meets all applicable requirements of 29 CFR 1910.29.
