Section 5(a)(1) of the Occupational safety and Health Act of 1970:  The
employer did not
furnish a place of employment free from recognized hazards that were
likely to cause death
or serious physical harm to employees working from a rough terrain
forklift elevated
personnel platform.
A feasible means of abatement would be to insure that employees wear
appropriate fall
protection as required.
Among feasible means of abatement would be to comply with the American
Society of
Mechanical Engineers, ASME B56.1-2000 Safety Standard for Low and High
Lift Trucks.
a)  Chicago Messenger Service dba Veterans Messenger Service - On or about
June 21, 2007
to present, the employer failed to ensure the personnel lift platform used
to elevate workers
to perform maintenance at their facilities was compliant with ASME
B56.1-2000.  The
hazards associated with this operation included, but was not limited to,
the lift platform was
not secured to the mast of the lift truck, the guardrail system did not
completely surround the
platform, the platform was not designed by the manufacturer or a competent
person with an
expertise in this area of engineering, the platform was not equipped with
an adequate
anchorage point, and the employee working on the platform was not provided
and required to
wear personnel fall arrest.
Abatement documentation is required for this item in accordance with the
requirements of 29
CFR 1903.19(d).
