Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by an unsupported structure: a)Construction site - 441/443 Washington St., Pottstown PA. In order to facilitate installing aluminum cladding on the horizontal support beam at the front of a porch roof, temporary vertical support posts were removed. This action compromised the stability of the roof, causing the roof to collapse on the worker underneath, on or about January 22, 2008. ABATEMENT NOTE: One feasible and acceptable method of abatement would be to maintain adequate support of the porch roof during installation of the aluminum cladding. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
