Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a) Yard Area, Universal Concrete - On or about 11/7/07 employees were exposed to being struck by a falling load or over turned crane as the weight of the load being lifted was not known. As such, it could not be determined if the load was within safe lifting limits as set forth in the load charts for the crane. A GROVE TM890 90 ton crane was used to lift a concrete slab of unknown weight from a trailer. During the lift the crane tipped over fatally injuring a truck driver. ABATEMENT NOTE: One feasible and acceptable method to abate this hazard is to comply with the Operator's & Safety Handbook for this crane where it is stated that the weight of load should always be known before any attept is made to lift it. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard: a) Yard Area, Universal Concrete - On or about 11/7/07 a GROVE TM890 crane was used to unload a piece of concrete from the deck of a flat bed trailer. The swing of the crane brought the crane's boom over top of the cab of the truck. At that instant the crane tipped over anfd the boom crashed into the top of the truck cab fatally injuring the driver who was seated inside. ABATEMENT NOTE: One feasible and acceptable method to abate this hazard is to comply with the "Operator's and Safety Handbook" which warns against elevating and lowering the boom without ensuring the area above and below the boom is clear of obstructions and personnel. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
