Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) Warehouse Area, Trash Conveyor, First Floor - The employer fails to prevent employees from standing on the roller conveyor and using it as a work platform. On or about 1/16/08 an employee working as a wave monitor climbed up on roller conveyor to reach up to the moving belt conveyor to retrieve product that had fallen from the top floor. The roller conveyor is 28 inches above the floor. Employees are thus exposed to a fall hazard. ABATEMANT NOTE: Among other methods, one feasible and acceptable method to abate the hazard is to prevent employees from accessing the roller conveyors. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
