Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being ejected from and crushed by/caught between when using powered industrial trucks (PIT's) without ensuring that employees utilize personal restraining devices: Warehouse - Employees operated a Toyota forklift truck without using the personal restraining device (seat belt) supplied/installed by the manufacturer. The proper use of these devices would protect employees from death or serious injury in the event the powered industrial truck would tip or roll over, on or about 3/19/08. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure employees use active operator protection devices, when provided, in accordance with Industrial Truck Standards Development Foundation "Safety Standard for Low Lift and High Lift Trucks" (ITSDF B56.1-2005). Abatement certification is required within 10 days after the abatement date. The certification shall include a statement that abatement is complete, the date and the method of abatement, and a statement indicating employees and their representatives were informed of this abatement.
