Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that the employer did not
take measures to repair defective
automotive lifts in the shop exposing employees to a crushing hazard of
falling vehicles:
a)  Repair Shop, Bay 1 - Employees use a Globe (Serial Number D70821) two
post semihydraulic lift
to elevate vehicles.  The lift had a defective locking mechanism on the
operator side preventing the lift
to safely lock into place, on or about August 15, 2008.
b)  Repair Shop, Bay 3 - Employees usa a Globe (Serial Number W-70085) two
post semihydraulic lift
to elevate vehicle.  The lift had a defective locking mechanism on the
operator
side and the lock on the
non-operator side had a metal pin placed in front of the locking mechanism
to keep it from locking
into place, on or about August 15, 2008.
Among other methods, some feasible and acceptable abatement methods to
correct this hazard are to:
1.Provide and maintain an automatic mechanical device to hold the lift in
the fully extended
position at the rated load capacity, as per Automotive Lift Institute
Standard for Automotive
Lifts.
2.Perform daily inspections of the locks before the start of each shift to
ensure that they are
working properly.
Abatement certification required within 10 days after abatement date.  The
certification shall include a
statement that abatement is complete, date and method of abatement, and
states employees and their
representatives were informed of this abatement.
