Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, including severe burns, to employees in that employees were exposed to dust explosion, deflagration, or other fire hazards from a dust collector being located inside a building. a) Laminate Counter Top Production Area - On or about July 16, 2008 the Dustek Model 2000, 60 cubic foot capacity dust collection system, collecting an explosive dust generated during the processing of plastic countertops was located inside the building. ABATEMENT NOTE: Among other methods, two feasible an acceptable abatement methods to abate the hazard are: a. to locate the dust collector outside of the building or b. Comply with the National Fire Protection Association (NFPA 654) standard for the Prevention of Fire and Dust Explosions for the Manufacturing, Processing and Handling of Combustible Solids Section 7.13.1.1.2. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
