Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: LOCATION: 96 Oval Court New Rochelle, NY On or about 11/9/07 a) The employees were working below the climber discarding a tree branch into the chipping machine. They were exposed to the hazard of being struck by falling tree branches. Among other methods, one feasible and acceptable method to correct the hazard is to: Follow paragraph 9.5.5 of the American National Standard for Arboricultural Operations, Pruning, Repairing, Maintaining, and Removing Trees, Cutting Brush- Safety Requirements, ANSI Z133.1 Revision October 2000, which states: Workers shall be positioned and their duties organized so that they are not directly in the work zone. NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
