Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of a potential oxygen-deficient atmosphere and toxic gases and vapors when entering into confined spaces such as a manhole. On or about 2/7/08 Location: 151 Greenvale Ave., Yonkers, NY Feasible means of abatement include developing and implementing a confined space program that provides for completing permits prior to entering permit-required confined spaces; conducting air monitoring to assess atmospheric hazards prior to entering into confined spaces; implementing and documenting rescue procedures; enforcing consistently all provisions of the confined space program; and/or complying with the American National Standards Institute Safety Requirements for Confined Space ( ANSI Z117.1-2003). NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
