Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by dock leveling devices: Location: 300 Executive Blvd Elmsford NY 10523 On or about 6/2/08, a) A dockboard was not provided with toe guards that extended through the full recess length for the full operating range of platform travel. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THE HAZARD IS TO FOLLOW SECTION 4.3.2 OF ANSI MH30.1-2000 (American National Standard for the Safety, Performance, and Testing of Dock Leveling Devices) which states "A smooth-faced toe guard shall be provided on the sides of the dock leveling device through the full recess length for the full operating range of platform travel. A toeguard shall also be provided for the rear edge of the dock leveling device if the edge is vertically movable. The guards shall be rigid enough to restrict placement of a foot under the platform." NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.ce
