Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by motor vehicles and construction equipment: Location: Rte 306 between Grandview & Willow St Monsey NY On or about 7/1/08, a) Workers were working without high-visibility safety apparel in a workzone in which construction equipment and construction vehicles were operating and also were adjacent to an active roadway that used cones for normal traffic separation. NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19. Among other methods, a feasible and acceptable abatement method to correct this hazard is to follow Section 6D.03B of the Manual on Uniform Traffic Control Devices for Streets and Highways 2003 Edition which states "all workers exposed to the risks of moving roadway traffic or construction equipment should wear high-visibility safety apparel meeting the requirements of ISEA "American National Standard for High- Visibility Safety Apparel" (see Section 1A.11), or equivalent revisions, and labeled as ANSI 107-1999 standard performance for Class 1, 2, or 3 risk exposure."e
