Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by a structure used to support lever chain hoists: Location: 1 Ridge Hill Yonkers, NY 10710 On or about 9/24/08, a) An employee was struck by a structure used to support two lever chain hoists when the structure slipped off wedges that were used to aid in supporting it in place. The employee was between the load and the supporting structure at the time of the accident. Among other methods, feasible and acceptable abatement methods to correct this hazard is for the employer is to 1): follow the manufacturer's Parts, Operation and Maintenance Manual for Lever Chain Hoist Model SLB300. The manual states "Supporting structures and load-attaching devices used in conjunction with this hoist must provide adequate support to handle all hoist operations, plus the weight of hoist and attached equipment. This is the customer's responsibility. If in doubt, consult a registered structural engineer." and 2): follow ASME B30.21-2005 Manually Lever Operated Hoists which states "The operator shall not apply a load to the hoist until the operator and all other personnel are clear of the load." NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
