Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: Hhazard of falling from the shop built scaffold as a result of a lack of or incomplete forklift operator training: West Gin, Inc.- on or about November 6, 2007, employees were attempting to repair a Burr House door, employing a shop-built scaffold supported by a Champ Model CB 606 Forklift, Serial # CC830132. The employer did not assure that only trained operators were permitted to operate the forklift. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require all forklift operators to complete forklift operator training as specified in ANSI B56.1-2005, Safety Standard for Low and High Lift Trucks, Section 4.19 "Operator Training". In addition, Section 4.17 "Elevating Personnel", addresses work platform attachment, assuring that " the platform attachment means are applied and the platform is securely attached to the lifting carriage or forks".
