Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following hazards: Employees are potentially exposed to loads falling on them or being struck by a moving load from poor maintenance/inspections on the hoists; (a)On or about August 24, 2007, at 6350 Hwy 90, Seguin, TX, frequent and periodic inspections were not being conducted on hoists/cranes. Employees are exposed to a struck by hazard from the loads falling or being struck by moving loads from a lack of or poor maintenance and inspections on the hoists/cranes. Among the hazards observed were: 1. Staging area (welding station) 1, Abel Howe, a five (5) ton and Harrington 5 ton hoist. 2. Staging area (welding station) 2, CM, a two (2) ton hoist, direction was not indicated on the controls. 3. Staging area (welding station) 3, CM Lodestar hoist. 4. Staging area (welding station) 4, Harrington, two (2) ton hoist. 5. Staging area (welding station) 5, Loadmaster hoist, direction was not indicated on the hand control and there was a hole in the hand control were a knob was to be. 6. Staging area (welding station) 6, Harrington, two (2) ton hoist, the clasp on the C hook was removed. 7. Staging area (welding station) 9, 5 ton hoist. 8. Staging area (welding station) 10, 5 ton hoist. 9. Staging area (welding station) 11, hoist. 10. Staging area (welding station) 13, Coffing, two (2) ton hoist, the hand control directions were gone and the hand control buttons were melted. 11. Staging area (welding station 14 & 15) hoist. Among other methods, one feasible and acceptable means to abatement this hazard is to place a load limit on the hoists and conduct frequent and periodic inspections of the hoists in accordance to the guidance from ANSI B30.16.
