Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falling to the ground below in that: a)On or about October 3, 2007, at 335 East Whitestone Blvd (1890 Ranch Project), Cedar Park, TX, employees were working out of the bucket of the (Ingersoll Rand) that was extended to the top of the wall without protection from falls. Among other methods to protect employees, one feasible and acceptable method would be to prohibit employees from riding and working out of the bucket.
