Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falls when standing and sitting on the guard rails of an elevated platform: (a) At the construction site where one employee was sitting on the out side of the top rail and another employee standing on the mid rail of a JLG 2630 ES scissor lift, exposing the employees to the hazard of falls of approximately 10 feet onto a concrete floor: Among other methods, one feasible and acceptable method to correct this hazard is to comply with ANSI/SIA A92.6 1990, paragraph 7.11.1, Personnel Footing. Personnel shall maintain a firm footing on the platform floor while working thereon. Use of planks, ladders or any other device on the aerial platform for achieving additional height or reach shall be prohibited.
