Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of a toxic atmosphere due to the potential presence of hydrogen sulfide and/or methane gasses. a) On or about 04/09/08 an employee working for Gillingwater Excavation was potentially exposed to an oxygen deficient atmosphere as well as potentially exposed to hydrogen sulfide and methane gas while entering an active manhole without the benefit of comprehensive confined space entry procedures in that; elements such as, but not limited to the following were not addressed. 1. A confined space entry permit system was not in place. 2. Atmospheric testing was not done prior to confined space entry. 3. The employer did not provide a ventilation system to ensure a safe atmosphere prior to and during work inside the manhole. 4. The employer did not assess whether or not appropriate PPE was required. 5. The employer did not have an emergency response rescue program in place. Among other methods, one feasible and acceptable abatement method to correct this hazard is the implementation of a confined space entry program in accordance with ANSI Z117.1 1989.1
