Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falling from an elevated bucket. a) Three employees were exposed to a fall hazard of approximately 14 feet while working on a stone structure from the front bucket of a New Holland backhoe. Among other feasible and acceptable means of abatement, one method of abatement would be to use equipment manufactured for this purpose such as an aerial lift or a scaffold.red
