Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of: a) At the site, the mail dumpers are being used with improperly repaired retainer bars. These bars are spring loaded and held in tension with a retainer pin. These retainer pins have been repaired/ replaced with none equivalent items such a screws (of various grade), "I" bolts, and hex bolts. These replacement parts can shear off causing internal parts of the retainer bar, which are under tension, to became a projectiles. Among other methods, one feasible and acceptable abatement method to correct the struck by hazard is to repair all retainer bars with the equivalent parts supplied or recommended by the manufactured.
