Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falls from elevations: a) At the site, an employee was standing on a wooden pallet being elevated by a forklift. The employee was working from the pallet at a height of approximately 50 feet. While working at this height the employee did not have any fall protection, thus being exposed to a 50 foot fall hazard. Among other methods, one feasible and acceptable abatement method to correct the hazards is to use a personnel basket designed and/or approved by the forklift manufacture for that model forklift.
