Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of a rigging failure; being struck by falling equipment/rigging; being struck by the winch cable due to an unexpected release as a result of improper installation of a winch used for lifting applications and inadequate winch equipment inspections: (a)Jobsite, 450 Technology Drive, Pittsburgh, PA: On or about 8/11/08 a Dayton electric winch, Model 3VJ72, Serial #21004019, (build date 6/12/02) was installed on the roof of the building and was being used to "hoist" materials from the first floor up to the roof through openings in the five floors. The winch was bolted to a pair of angle irons and clamped to an aluminum box beam. The winch cable exited the top of the winch between the two aluminum hex tie bars, one of which was heavily abraded. The wire rope cable then traveled to a pulley block, which was not the original manufacturer's, and was rigged on a mobile scaffold and secured only with vise-grip locking clamps. In addition, the wire rope was twisted through the pulley block. The winch was designed for hauling and pulling operations and not to be used as a hoist. Among other methods, one feasible and acceptable abatement method to correct this hazard is to use, install and maintain lifting equipment, hoists, that are designed for vertical lifting and meet the requirements of the American Society of Mechanical Engineers (ASME) B30.16, "Overhead Hoists" or the Hoist Manufacturer's Institute requirements.
