Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard of ten to twelve feet to the ground below while unloading bundles of shingles from the pallet which was on the forks of a bob-cat loader and raised greater than ten to twelve feet above the ground. Among other methods, one feasible and acceptable method to correct this hazard is to use the escalator that was on site and designed for this purpose. a.On or about August 29, 2007, at the front of the job site, a employee was exposed to a fall hazard of ten to twelve feet to the ground below while he was unloading bundles of shingles from the raised pallet which was on the forks of the bob-cat loader.
