Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of working in water: Water Hazard #4, Padre Isles Country Club: The employer did not ensure that employees engaged in golf ball retrieval operations were provided with information and training regarding the hazards of working in water. One recognized and approved method is to provide employees with information and training regarding the hazards of working in water while engaged in golf ball retrieval operations.
