North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:
The employer did not furnish each of his employees conditions of
employment and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to: Crush by hazards when starting equipment
while standing in the wheel path.[

possible. Machine could
run over you or others. Learn how to use all controls. Start and operate
only from operator's position.
a)job site - on or about 9/25/07  the foeman and ground based employees
were bypassing the
starter switch  on the "Ditch Witch 8020 Turbo" trenching machine with a 1
ft piece of #9
copper wire to jump the solenoid to the starter, disabling the interlock
to allow engine start
while the machine was in gear.
Abatement note: One means for abatement is to clean and tighten the
starter
keyed switch
connections and develop policy to prevent the use of devices intended to
by-pass factory safety
measures.
