North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to fall hazards associated with an improperly
erected scaffold:
a)At jobsite- the canopy sidewalk scaffold (F07SP)  9 ' X 6 ' and the open
frame
scaffold (F06L) 20'6" X 5' were being connected using a steel I-beam
(W8X10) and
C-clamps (JBC) to attach both scaffolds. One C-clamp was not installed
with an
approximate 45 degree angle to the shore head and the beam. The connection
was
unstable and was not set up according to manufacturer recommendations.
b) At jobsite- the C-clamps (JBC) used to attached both scaffolds did not
have a load
rating.
c)At jobsite- the shoring components used to connect the scaffolding were
not used as
recommended by the manufacturer.
