North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm in that employees were
exposed to the hazards of falling from, being struck and/or crushed by the
bucket of a skid steer loader when
standing elevated bucket at approximately 6 feet overhead:
a)site, yard - where an employee was observed standing in the bucket of a
slowly moving Bobcat
Compact Skid Steer Loader, model S185, s/n 525023717, at approximately 6
feet above the
lower ground level while performing landscaping when placing and setting
trees for planting.
Feasible and acceptable abatement methods, among others, to correct this
hazard is to:
1) prohibit employees from placing their body or any part thereof inside
and/or onto the
bucket, sitting on the bucket and/or standing on any part of the bucket or
skid steer
loader other than that which is designed specifically for personnel
seating at all times,
2) train all employees on the specific requirements associated with skid
steer loader use
and the appropriate warning and cautions associated with known and/or
suspected
hazards when they will be working around and/or assisting with work where
a skid steer
loader will be used.
