North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm in that an employee was exposed to the hazard of falling or being thrown from, being struck and/or crushed by a ROPS equipped, powered industrial truck when not using the installed and attached seatbelt: a)site, where an employee was observed operating a Yale Powered Industrial Truck, model GLP050TGEUAV086, serial #A875B23511A, 5,000 lbs capacity, equipped with rollover protective structures (ROPS) when the installed and attached seat belt was not fastened and in use. Feasible and acceptable abatement methods, among others, to correct this hazard is to: 1) prohibit employees from operating powered industrial trucks without the installed seatbelt fastened and in use when equipped with rollover protective structures (ROPS), 2) train all operators on the specific requirements associated with powered industrial truck usage and the associated warnings and cautions.
