North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:
The Employer did not furnish to each of his employees conditions of
employment and a place of employment
free from recognized hazards that were causing or likely to cause death or
serious
physical harm to employees,
in that employees were exposed to crushing/struck by injuries or death
while operating automotive lifts with the
safety locks welded to the open position:
a)  Establishment - Automotive lift, Pro-Lift, model Sp-12, SN2766, had
the safety locks spot welded
to the open position to prevent them from engaging as designed.
Ref: ANSI  B153.1-1981, Part 3, pg 6, para 3.1.10:  All automotive lifts
shall be equipped with
mechanical locking devices.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to
establish a pre-use inspection checklist that includes the operational
check of the lift and locking device prior to
applying a load.
