Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to:

that were causing or likely to cause death or serious physical harm to
employees in that the
Site Safety Directors, as first aid responders, were exposed to the
hazards of being infected
with Hepatitis B through exposure to blood and other potentially
infectious materials:
a) On or about 8/16/07, prior and continuing, employees have sustained
lacerations
working with sheet metal, using electric knives and other
equipment/materials and
have been provided first aid by the site first aid responders.  The site
first aid
responders have not been offered Hepatitis B vaccinations free of charge
to protect
them from the hazard of Hepatitis B; information has not been provided for
site first
aid providers on the Hepatitis B vaccine, including information on the
efficacy,
safety, method of administration , the benefits of being vaccinated and
that the
vaccine and vaccination will be offered free of charge; and the necessary
recordkeeping for medical training records have not been kept.
Feasible and acceptable abatement methods for reducing these hazards,
among others, are:
(1) Offer Hepatitis B vaccinations, free of charge, to the designated
first aid responders (site
safety directors); (2) provide effective training to the designated first
aid responders,
including information on the efficacy, safety, method of administration ,
the benefits of being
vaccinated and that the vaccine and vaccination will be offered free of
charge;
and (3)
maintain accurate records of all vaccinations and training for these
individuals.
