Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of: a.On or about October 4, 2007, the hazard of an employee being crushed by a powered industrial forklift while operating a Hyster, rated at 15,000 lb, #1501, did not use/wear the installed seat belt. The employee operated the Hyster forklift in the yard. One feasible and acceptable abatement method, among others, to correct this hazard would be to have operators to wear the provided restraint devices or seat belt and enforce the procedure. *** Certification and Documentation of Abatement Required ***
