Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that an employee was
exposed to:Crushing injuries from a double drum vibratory asphalt
compactor overturning
or falling off and being struck by the adjacent vehicles moving through
the work zone due
to the fact that the operator restraint system, (seat belt) provided on
the Caterpillar CB-
334D was not being used by the operator. Among other methods, two feasible
and
acceptable methods to correct this hazard are to require and effectively
enforce the use of
the operator restraint system provided for use by the manufacturer and to
adhere to SAE
J153 Surface Vehicle Recommended Practice, Section 4.2 Operator-General
Precautions,
which instructs operators: "Wear the seat belt to maximize the protection
capability of a
ROPS (Roll Over Protective Structure) when the machine is so equipped."
On or about February 29, 2008 and at times thereto, at the work-site
located at Hwy 18
east of Jonesboro, Arkansas an employee was exposed to crushing and
struck-by injuries
from a double drum vibratory asphalt compactor overturning or falling off
and being
struck by the adjacent vehicles moving through the work zone due to the
fact that the
operator restraint system, (seat belt) provided on the Caterpillar CB-334D
was not being
used by the operator.ar
