Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the jobsite located at the Riverpointe Apartments, 7325 Riverpointe Drive, North Little Rock, Arkansas, Building 7351 on or about April 29, 2008, an employee was observed operating a Caterpillar rough terrain forklift without wearing a seat belt. This condition exposed the employee to the hazard of being struck by the rollover protective structure in the event of a tip over. One feasible abatement method would be to establish a policy that requires the use of seat belts, requires communication of it to employees, and enforces the use of the seat belts.es
