Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the jobsite, located at 2001 Hampton Place, Rogers, Arkansas, forming stakes around the building and near walkways were not capped, exposing employees to the hazards of impalement in the following instances: (a)approximately 1 to 2 feet from the exterior of the building under construction where roofing work was being performed above the stakes (b)near walkway were employees could trip and fall onto the stakes Among other methods, one feasible and acceptable abatement method to correct this hazard is to place protective caps over the ends of the forming stakes.
